EUROPEAN LAW
From the day of Polish accession to the structures of the European Union - the European Law within the Polish legal order has became extremely important. European Law confers rights and imposes obligations directly not only on the Community institutions and the Member States but also on the Community citizens - it is so called "direct effect" or "direct applicability" of European Law. It means that the parties may indicate provisions of European Law in front of Polish courts and agencies in order to require their rights. Moreover European Law has a primacy over national law - it means that the national authorities (courts, agencies) cannot apply the national provision if in the certain cases it may be contrary to the Community provisions. Without any doubts, Poland as a member of the European Union must respect the principle of primacy.
